Australian Terms and Conditions for Pygmees Clothing:

The following terms and conditions are set in place for Australian retail customers purchasing PYGMEES clothing. These terms and conditions cover all orders placed within Australia, with the Australian agent/distributor, either by email or by phone.
Sales Contract:
In this agreement you shall be know as “The Retailer”, and Monique Drinkwater shall be known as “The Agent”.
Minimum order for Retailers & Credit Application
There stands a minimum order of $500 for retail purchasers, unless pre arranged between agent and retailer.
By completing and signing the credit application form The Retailer agrees that these terms and conditions contained herein are binding between The Retailer and The Agent and that any future orders placed by The Retailer will be subject to these terms and conditions.
Product Shipment
Pygmees clothing is designed in France and is manufactured in Bali. Two collections are released per year. Spring/Summer will arrive to your store around June/July each year and Autumn/Winter will arrive around February/March each year. Each collection is showcased at the both annual Fashion Exposed Events in Australia.
Melbourne’s Autumn Winter event in September of each year and Sydney’s Spring Summer event held each February. For a visual disc of each collection and an order form, contact monidangerous@gmail.com
Policy on Refunds, Returns and Credit Notes
1. Any discrepancies with received product must be reported within 7 days of receipt with no exceptions. After 7 days there will be a cancellation penalty of %50 of total order charged to The Retailer. After 15 days %100 of the total of order will be charged to The Retailer.
2. Please inspect merchandise immediately upon arrival of delivery.
3. Returns will only be accepted for products that are faulty as a result of manufacturing error and no credit will be given for products that are shop soiled.
4. Any stock in perfect condition, with tags, labels and packaging in place, can be returned to the agent within 7 days, at the customer’s expense for a full credit per item
5. When returning items we strongly recommend you obtain proof of postage/delivery, as we accept no responsibility for parcels lost in transit.
6. Returns will be repaired or replaced at the discretion of The Agent. If a product cannot be repaired or replaced a credit will then be issued to The Retailers account.
7. Customers will contact the agent to obtain a return authorization number before mailing the damaged, faulty or returned on credit items back.
8. All clothing will be looked over by the agent on the arrival of parcel in to Australia, and then orders will be dispatched to The Retailer in perfect condition.
9. There is a minimum order of 4 items per colour and code in any size range.
Payment Policy
A 30% deposit of total order will be expected upon placement of order.
All credit notes and refunds will be finalised and dispatched with in the 21 days of outstanding invoice.
All retailers will be given a 21day account on invoice, from date of dispatch of items from Agent to The Retailer.
If for whatever reason we are unable to supply the goods you have ordered, we will reimburse the 30% payment made on goods within 21 days.

The account must be paid in full by the end of the 21 days or a daily calculated penalty of $5 dollars a day will be added to invoice.
Copy Right
Pygmees clothing Pty Ltd holds copyrights for all material designed and produced. No goods or design may be copied or reproduced for any purpose.
Changes
The Agent reserves the right to change and update Terms and Conditions of sale al changes will be made clear to The Retailer within 30 days of changes implemented.
DISCLAIMER
Every effort will be made to ensure that all the information about any product featured on fantastic.com.au website (home of the Australian arm of Pygmees) is accurate, but we can’t absolutely guarantee it. Any changes in stock availability will be communicated to the Australian agent/distributor and passed onto the customer in Australia.
The customer can then change their mind or if the communication comes after the order has been dispatched from Bali, the Australian Agent/Distributor will let you know as soon as possible, and the customer can exchange or return them in accordance with the Returns Policy.
PRIVACY
We follow strict security procedures, as required by the Australian Data Protection Legislation regarding the storage, and disclosure of any information given by you. Under these guidelines we offer our assurance of total confidentiality and promise that your details will not be disclosed to any to other companies.
